Travel Terms and Conditions

Travel agreement

1 Completion of Travel agreement

The customer is bound to the conditions of the travel agent (Lin Thei …). The booking must be in writing.  The first named person on the booking will be the party leader and will be responsible for making all payments due to us. He/she must be authorized to make the booking on the basis of these booking conditions by all persons on the booking. By submitting a booking, the party leader confirms that he/she is so authorized and that all party members agree to be bound by these booking conditions.

The party leader can cancel the trip in writing within 10 days.

2 Payment

A deposit of 80 Euros is to be paid upon booking. Payment should be made directly by cheque or bank transfer. No-one else except the organizer is liable to accept payment. The remaining payment is to be transferred at the latest 6 weeks before travel.

If we do not receive all payments due in full and on time, we are entitled to assume that you wish to cancel your booking. In this case, we will be entitled to keep all monies paid or due at that date. If we do not cancel straight away because you have promised to make payment, you must pay the cancellation charges shown in clause 4 depending on the date we treat your booking as cancelled.

 

3 Leistung (Service)

We are bound to provide the services as set out in the event description and event confirmation. Supplementary agreements are not part of the contract. Place or hotel brochures received by the customer are for information only.

4 Amendments and cancellations

 

The customer can cancel at any time before travel. 

a)     Any amendment or cancellation requests must be in writing and by the person who made the original booking, and paid the deposit. Administration costs will be charged as followed:

 

Till 30 days before departure : 80€

15 – 29 days before departure : 30% of trip price

8 – 14 days before departure : 50 % of trip price

1 – 7 days before departure : 75 % of trip price

 

When the customer submits no cancellation in writing but does not travel then the cancellation fee is 100 % of the trip price.

 

b)     Up till departure the customer can substitute with another person. Amendment fee is 20 € pro person.

c)     A fee will be charged for changes to the invoice (eg Departure date, type of room etc)

d)     Cancellation insurance is available from Lin Thei. The price is not included in the trip price. With this insurance only the deposit is payable in case of non-travel.

 

5 Services not included

 

The organizers are not liable for compensation should the customer have to return earlier than planned. If the organizer receives any refund it will be passed on to the customer.

 

6 Cancellation by the organizer

 

The organizers have the right in the following cases to cancel or revoke the booking before departure:

Till 6 weeks if the participant numbers do not reach 120. The customer must be informed in time. Should it become clear earlier that the required numbers will not be reached or for other unpredictable reasons the trip cannot take place, the organizers are obliged to inform the customer immediately. If the trip is cancelled the customer will be refunded in full.

 

 

7 Revocation of agreement due to unusual circumstances

 

If the trip cannot take place due to war, natural catastrophe etc without endangering the customer, the organizer or the customer can cancel the booking. If the agreement is revoked then the organizers can claim appropriate compensation for services already supplied or for administration costs entailed. If the agreement is revoked after the trip has started then the organizers should provide the customer with help organizing the return trip. The customer is obliged to pay any extra costs involved.

 

 

8 Organizers liability

a)     The organizer is liable for being diligent as a proper manager in providing

. travel preparation

. selection of the funding agency

. correct description of services

. adequate provision of agreed services taking into consideration the local rules of the destination country and place

 

b)     The organizer is not liable for disturbance in service caused by foreign service providers

c)     We are not liable for advertisements in the hotel brochure, day trips or offers from other service providers who we have no influence over and whose integrity we cannot check.

 

9 Exclusion of claims and limitations

Claims for non provision of agreed services should be made in writing by the customer within one month after the conclusion of the trip. After expiry date the customer can still however, file a claim provided he has a valid reason, for example that the organizers could not be contacted etc.  The period of time for filing a claim is limited to 6 months. The claim period begins on the first day after the travel agreement should have expired. The time period is calculated to the date the claim is processed.

10 Passport, visa and health regulations

The customer is himself responsible for passport, visa and health provision. Any disadvantages arising from not following the regulations are borne by the customer even if changes have been made after booking the trip. As far as possible, the organizer will inform the customer of any known changes in regulations, before the trip begins. Information about Embassy’s will be provided for non-Germans. Customers from other countries where visas are required must make sure they have the visa on time. If the visa has not been issued on time and the customer is prevented from travelling, the organizers are entitled to charge the customer.

11 Disturbances caused by the customer

The organizers can immediately cancel the agreement if the customer, despite a warning, continues to disturb to an unreasonable point. This also applies if the customer does not obey the rules. In this case the organizer is not obliged to reimburse the cost of the trip.

12 General

The event program may be subject to change due to technical reasons. All entries in the brochure were current at the time of printing and may be subject to errors and emissions. In the event of the darts machines breaking down, we will attempt to provide substitutes. If this is not possible then we cannot be held liable, although, if this is the case, the start money for the games will be refunded. This will be calculated on what a customer pays who does not take part in the dart tournaments. There is no possibility to claim for theoretical loss of prize money.

13 Legality

Aachen has been agreed as the legal venue for claims against us.  Only claims involving non-provision of services should be addressed to us. The customer is recommended to declare withdrawal from the agreement in writing. Claims against airline companies should be agreed with the airline company itself.
